TCSDAILY “KUDLOW CREED”  VIDEO CONTEST OFFICIAL RULES

This promotion is intended for play and participation in the United States only and shall be construed and evaluated according to the laws of the State of Virginia and the United States.  Please do not enter if you are not located in the United States or if you are located in the State of Rhode Island or Puerto Rico.  YOU MUST HAVE AN ACCOUNT WITH WWW.YOUTUBE.COM TO ENTER. YouTube accounts are available at no cost.

1.   TO ENTER: Create a video illustrating “The Kudlow Creed” for your chance to win $2,500 (“Contest”).

Visit www.tcsdaily.com  (“TCS DAILY website”) between January 1, 2009 and October 15, 2009 to enter.  Click the “Kudlow Creed Video Contest” banner.  Click on the “Contest” (link).  From there, click on the “Click Here to Enter” link which will take you to http://www.youtube.com/group/tcsdailykudlow  (“Contest Website”). Click “Join This Group”, and then click “Add Videos”, following the instructions set forth on the Contest Website.  After submitting your video, please email us your name, YouTube ID and a link to your video at info@tcsdaily.com.  The Video must be uploaded and the email must be received by 11:59 p.m. Eastern Time on October 15, 2009. 

The video should focus on the theme of The Kudlow Creed: “We believe free market capitalism is the best path to prosperity.”  (“Video”). For more information, click on the banner ad located on the TCSDAILY Website www.tcsdaily.com

Your entry is incomplete until you submit both a video and send us an email with your information.  YOU MUST HAVE AN ACCOUNT WITH YOUTUBE TO ENTER THE CONTEST.   Please review the terms of use and privacy policy located on www.youtube.com for information regarding how your personal data is treated when using YouTube. 

All entries become property of TCS DAILY (“Sponsor”) and will not be returned or acknowledged.  Sponsor is not responsible for incorrect or inaccurate entry information or for late, lost, destroyed, misdirected or incomplete entries, or for computer system or phone line, high-speed data line errors, software, hardware malfunctions or other errors, failures or delays in transmissions that are human or technical in nature. Entries generated by a script, macro or other automated means will be disqualified.

By entering you agree to be bound by the terms of these Official Rules.  Void outside the United States, Rhode Island, Puerto Rico and where otherwise prohibited by law.  By entering you understand that the Contest Website is owned by a third party, not Sponsor, and the privacy policy and terms of use located on the Contest Website govern your use and personal data protection while on the Contest Website. By entering you agree that Sponsor shall not be responsible or liable for your use of the Contest Website. 

2.  PRIZE: One (1) winner will receive $2,500. One (1) second place winner will receive $1,000. One (1) third place winner will receive $500.

3.  HOW TO WINThe Video must be submitted on the Contest Website.  Follow the instructions located on the Contest Website in order to submit your Video. The Video must be two minutes or less in length and not more than 10 megabytes in size. 

Sponsor will evaluate and select the Videos of the finalists on April 1, 2009.  Sponsor will determine the three (3) finalists, in its sole discretion, based on the: 1) creativity of the Videos; and 2) substance of the Video and its connection to theme “The Kudlow Creed.”

Fifty percent (50%) of the judging will be based on creativity of the Videos and fifty percent (50%) of the judging will be based on the substance of the Video.  All decisions are final in all matters. Entries will not be acknowledged or returned.

4. DISTRIBUTION OF PRIZES: The winner will be contacted by email or their YouTube User ID within forty-eight (48) hours of the Judges’ decision.  The prize, once issued, is nontransferable and cannot be reissued.

The winner will be required to complete an affidavit of eligibility/liability release prior to receiving the prize. 
Sponsor reserves the right to substitute a prize of equal or greater value. 
All applicable taxes on the prize are the sole responsibility of the winner.

5.  ELIGIBILITY:  Contest is open to legal residents of the United States (except for Rhode Island and Puerto Rico), 18 years of age and older.  Employees of Sponsor and its subsidiaries, affiliates and advertising/promotional agencies, if any, involved with this promotion, including the immediate families and household members of such employees are not eligible to enter or win.

6.  RELEASEBy accepting a prize, the winner agrees to release and hold Sponsor, and its respective directors, employees and agents, harmless from any liability, loss or damage incurred from participating in this Contest, or the use, misuse or acceptance of prize, or attendance at the event.
Acceptance of a prize constitutes permission for Sponsor to use winner’s name, photograph or likeness for purposes of advertising and promotion of the event or otherwise without further compensation, except where prohibited.

7.  GENERAL:  Sponsor reserves the right, in its sole discretion, to cancel or suspend the Contest should a virus, bug, malicious tampering or other causes beyond the control of Sponsor corrupt the administration of contest.

Sponsor reserves the right, at its sole discretion, to disqualify anyone found to be: 1) tampering with the entry process or the operation of the Contest, 2) acting in violation of these Official Rules, or 3) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person.

Any attempt by a contestant or any other individual to deliberately damage the TCSDAILY Website or the Contest Website where online entries are received or undermine the legitimate operation of the Contest is in violation of criminal and civil laws.  Sponsor reserves the right to seek damages from any such entrant or individual to the fullest extent permitted by law.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Virginia, without regard for conflicts of law doctrine, and all proceedings shall take place in Atlanta, Georgia.

Sponsor shall not be liable to winner or any person claiming through winner for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sponsor’s or Sponsor’s sole control.

8.  WINNER LIST:  To obtain the name of the winner, send a self-addressed stamped envelope to TCSDAILY VIDEO CONTEST c/o Grace Creek Media, 7950 Jones Branch Drive, McLean, VA 22108 by April 30, 2009. 

9.  DATA COLLECTION:  Sponsor will be collecting personal data about participants when they enter the Contest. By participating in the Contest, entrants hereby agree to the collection of personal data by Sponsor.
